This website (the “Site”) is owned and operated by Ant Hill Enterprises Pty Ltd (Anthill). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, our Refund Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from Anthill. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.

We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us. You acknowledge and agree that any contributions originally created by you for us shall governed by Section 35 of the Australian Copyright Act of 1968.  As such, the copyrights in those works shall belong to Anthill from their creation.  Thus, Anthill shall be deemed the author and exclusive owner thereof and shall have the right to exploit any or all of the results and proceeds in any and all media, now known or hereafter devised, throughout the universe, in perpetuity, in all languages, as Anthill determines.  In the event that any of the results and proceeds of your submissions hereunder are not governed by Section 35 of the Australian Copyright Act of 1968, you hereby, without additional compensation, irrevocably assign, convey and transfer to Anthill all proprietary rights, including without limitation, all copyrights and trademarks throughout the universe, in perpetuity in every medium, whether now known or hereafter devised, to such material and any and all right, title and interest in and to all such proprietary rights in every medium, whether now known or hereafter devised, throughout the universe, in perpetuity. Any posted material which are reproductions of prior works by you shall be co-owned by us.

You acknowledge that Anthill has the right but not the obligation to use and display any postings or contributions of any kind and that Anthill may elect to cease the use and display of any such materials (or any portion thereof), at any time for any reason whatsoever.

DISCLAIMER

The materials on the Site are provided “as is”. Ant Hill Enterprises Pty Ltd (Anthill) makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Ant Hill Enterprises Pty Ltd (Anthill) does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites, including social media, linked to this site.

WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SITE OR MATERIALS ON THIS SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, TIMELINESS, RELIABILITY OR OTHERWISE.

LIMITATIONS

In no event shall Ant Hill Enterprises Pty Ltd (Anthill) or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Anthill’s Internet site, even if Anthill or an Anthill authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

INTERACTIVE FEATURES

This Site and programs offered by Anthill may include a variety of features, such as membership sites, bulletin boards, web logs, chat rooms, and email services, which allow feedback to us and real-time interaction between users, and other features which allow users to communicate with others. Responsibility for what is posted on bulletin boards, web logs, chat rooms, and other public posting areas on the Site or elsewhere such as Facebook groups, Zoom webinars and Google Hangouts, or sent via any email services on the Site, lies with each user – you alone are responsible for the material you post or send. We do not control the messages, information or files that you or others may provide through the Site. It is a condition of your use of the Site that you do not:

  • Restrict or inhibit any other user from using and enjoying the Site.
  • Use the Site to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt any servers or networks used to provide the Site or its features, or disobey any requirements, procedures, policies or regulations of the networks we use to provide the Site.
  • Use the Site to instigate or encourage others to commit illegal activities or cause injury or property damage to any person.

  • Use the Site to post, transmit or in any way exploit any information, software or other material for commercial purposes, or that contains advertising.
  • Use the Site to advertise or solicit to anyone to buy or sell products or services, or to make donations of any kind, without our express written approval.
  • Gather for marketing purposes any email addresses or other personal information that has been posted by other users of the Site.

Ant Hill Enterprises Pty Ltd (Anthill) may host message boards, chats, Facebook groups, Zoom webinars, Google Hangouts and other private and public forums on its Sites and elsewhere. Any user failing to comply with the terms and conditions of this Agreement may be expelled from and refused continued access to, the Facebook groups, Zoom webinars, Google Hangouts message boards, chats or other private or public forums in the future. Anthill or its designated agents may remove or alter any user-created content at any time for any reason. Message boards, Facebook groups, Zoom webinars, Google Hangouts chats and other forums are intended to serve as discussion centers for users and subscribers. Information and content posted within these public forums may be provided by Anthill staff, Anthill’s outside contributors, or by users not connected with Anthill, some of whom may employ anonymous user names.

Anthill expressly disclaims all responsibility and endorsement and makes no representation as to the validity of any opinion, advice, information or statement made or displayed in these forums by third parties, nor are we responsible for any errors or omissions in such postings, or for hyperlinks embedded in any messages. Under no circumstances will we, our affiliates, suppliers or agents be liable for any loss or damage caused by your reliance on information obtained through these forums. The opinions expressed in these forums are solely the opinions of the participants, and do not reflect the opinions of Anthill or any of its subsidiaries or affiliates.

Anthill has no obligation whatsoever to monitor any of the content or postings on the message boards, chat rooms or other public forums on the Sites. However, you acknowledge and agree that we have the absolute right to monitor the same at our sole discretion. In addition, we reserve the right to alter, edit, refuse to post or remove any postings or content, in whole or in part, for any reason and to disclose such materials and the circumstances surrounding their transmission to any third party in order to satisfy any applicable law, regulation, legal process or governmental request and to protect ourselves, our clients, sponsors, users and visitors.

We may cancel or terminate your right to use the Site or any part of the Site at any time without notice. In the event of cancellation or termination, you are no longer authorized to access the part of the Site affected by such cancellation or termination. The restrictions imposed on you with respect to material downloaded from the Site, and the disclaimers and limitations of liabilities set forth in these Terms of Service, shall survive.

REVISIONS AND ERRATA

The materials appearing on Anthill’s Site could include technical, typographical, or photographic errors. Anthill does not warrant that any of the materials on its web site are accurate, complete, or current. Anthill may make changes to the materials contained on its web site at any time without notice. Anthill does not, however, make any commitment to update the materials.

LINKS

Anthill has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Anthill of the site. Use of any such linked web site is at the user’s own risk.

SITE TERMS OF USE MODIFICATIONS

Anthill may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

DISPUTE RESOLUTION

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, and any dispute shall be subject to binding arbitration in Victoria, Australia. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

CLASS ACTION WAVER

You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren’t allowed.

The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration.

SEVERABILITY

If any clause within this Provision (other than the Class Action Waiver clause above) is found to be illegal or unenforceable, that clause will be severed from this Provision, and the remainder of this Provision will be given full force and effect. If the Class Action Waiver clause is found to be illegal or unenforceable, this entire Provision will be unenforceable and the dispute will be decided by a court.

TERMS OF ‘PROGRAM’ OR ‘COURSE’ OR ‘MEMBERSHIP’ PARTICIPATION OR THE PROVISION OF ‘SERVICES’

Please READ the following with care. By purchasing a Program or Course or Membership or Services provided by Anthill, you (herein referred to as “Client”) agree to the follow terms stated in this document.

PROGRAM / COURSE / MEMBERSHIP / SERVICE

Anthill agrees to provide Programs, Products, Courses, Memberships and Services (herein referred to as the “Product”). Client agrees to abide by all policies and procedures as outlined in this agreement as a condition of their purchase or participation in the Product.

PRODUCT FEES

All Product fees are payable in USD.

METHODS OF PAYMENT

If Client elects to pay by monthly instalments, Client authorizes Anthill to charge Client’s credit card or debit card. If Client elects to pay in FULL, Client may pay by credit card or debit card.

REFUND POLICY

We want you to be content with your purchase, but we also want you to put forth your best effort to apply all the strategies and tactics in our Programs. We offer either a 30-Day or 60-day refund period for most Products, from date of enrolment. Please check the terms and conditions of the Product you purchased.

In the event that you decide that applying the strategies in the course did not work for you, check the terms of your Product and contact our support team at [email protected] and inform of us of your desire to refund. Your enrolment date is the date on your order receipt email, which is your date of purchase.

Refunds requested beyond the refund period (where applicable) will not be honoured.

Please note: If you opted for a payment plan and you do not request a refund within the refund period, you are required by law to complete the remaining payments of your payment plan. All refunds are at the discretion of Anthill.

CONFIDENTIALITY

  1. Client recognizes that our Products will involve Client and Anthill discussing proprietary information and trade secrets relating to themselves, their companies or related entities. Such information may include, without limitation, information with respect to Clients’ (or their affiliated entities’) operations, processes, products, inventions, business practices, finances, principals, vendors, suppliers, customers, potential customers, marketing methods, costs, prices, contractual relationships, regulatory status, compensation paid to employees or other similar information (the “Confidential Information”).
  2. Client shall not disclose or disseminate any such Confidential Information obtained during the participation in the Product, and shall only discuss confidential information learned during the Product within the Product itself.
  3. Client shall not post any pictures or video from any Product event on any web, social media, or internet site, or disseminate such pictures or video to any third party, without the express written permission of Anthill.
  4. While you are free to discuss your personal results from our Products, you must keep the experiences and statements, oral or written, of all other participants in the strictest of confidence.
  5. Suspension under this section does not void Client’s obligation to pay the entire Product fee owed. The Company has no obligation to reimburse any fees paid by Client.

NO TRANSFER OF INTELLECTUAL PROPERTY

Anthill Products are copyrighted and original materials that have been provided to Client are for Client’s individual use only and a single-user license. Client is not authorized to use any of Company’s intellectual property for Client’s business purposes, unless explicitly given permission (as for templates provided in program). All intellectual property, including Company’s copyrighted Products and associated materials, shall remain the sole property of the Anthill. No license to sell or distribute Company’s materials is granted or implied. By purchasing any Anthill Product, Client agrees (1) not to infringe any copyright, patent, trademark, trade secret, or other intellectual property rights, (2) that any Confidential Information shared by Anthill is confidential and proprietary, and belongs solely and exclusively to Anthill, (3) Client agrees not to disclose such information to any other person or use it in any manner other than in discussion with Anthill. Further, by purchasing any Product, Client agrees that if Client violates, or displays any likelihood of violating, any of Client’s agreements contained in this paragraph, Anthill will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.

CLIENT RESPONSIBILITY

Our Products are developed for strictly educational purposes ONLY. Client accepts and agrees that Client is 100% responsible for their progress and results from the Products. Company makes no representations, warranties or guarantees verbally or in writing. Client understands that because of the nature of the Products, the results experienced by each client may significantly vary. Client acknowledges that as with any business endeavour, there is an inherent risk of loss of capital and there is no guarantee that Client will reach their goals as a result of participation in the Products. Products education and information is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. Company assumes no responsibility for errors or omissions that may appear in any program materials.

TERMINATION.

Company is committed to providing all clients with a positive experience. By purchasing any Anthill Product, Client agrees that Anthill may, at its sole discretion, terminate this Agreement, and limit, suspend, or terminate Client’s participation in Products without refund or forgiveness of monthly payments if Client becomes disruptive to Company or Participants, Client fails to follow Products guidelines, is difficult to work with, impairs the participation of the other participants in the Products or upon violation of the terms as determined by Company. Client will still be liable to pay the total contract amount. We may cancel or terminate your right to use the Site or any part of the Site at any time without notice. In the event of cancellation or termination, you are no longer authorized to access the part of the Site affected by such cancellation or termination. The restrictions imposed on you with respect to material downloaded from the Site, and the disclaimers and limitations of liabilities set forth in these Terms of Service, shall survive.

EARNINGS DISCLAIMER:

Every effort has been made to accurately represent our Products and their potential.

There is no guarantee that you will earn any money using the techniques and ideas in our Products and materials.
